Terms of Service

1. About these terms

These Terms and Conditions ("Terms") govern your purchase of and access to the IPDATrader mentorship and your use of ipdatrader.com (together, the "Service"). The Service is operated by IPDATrader ("IPDATrader", "we", "us", "our").

By purchasing a membership, accessing any part of the Service or using this website, you confirm that you have read, understood and agree to these Terms. If you do not agree, do not purchase or use the Service.

2. Eligibility

You must be legally able to enter into a binding contract to purchase a membership. You are responsible for making sure that using the Service is lawful where you live.

3. What the membership includes

Depending on what is offered at the time you join, the membership gives you access to:

• the IPDATrader video course, including lessons added over time;
• a private Discord community, including Q&A, chart feedback and market updates;
• a live recap session on Zoom each Friday, which is recorded and made available to members;
• a recorded weekly outlook each Sunday.

Every plan (monthly, quarterly and yearly) includes the same access. Plans differ only in how often you are billed.

We may add to, change, reschedule or remove any part of the Service at any time, including course content, session times and community features. Live sessions may occasionally be moved or cancelled. Answers, feedback and replies in the community are given in good faith, with no guaranteed response time.

4. Educational purposes only. Not financial advice

Everything provided through the Service, including the course, Discord messages, live sessions, recordings, outlooks, chart feedback and YouTube content, is for general educational and informational purposes only.

Nothing in the Service is financial, investment, tax or legal advice, and nothing is a recommendation or solicitation to buy, sell or hold any financial instrument. Nothing takes into account your personal financial situation, objectives or needs. IPDATrader is not a licensed or registered financial adviser, broker or investment manager.

You are solely responsible for your own trading and investment decisions and their results. Consider seeking advice from an independent, licensed professional before making any financial decision.

5. Trading risk and no guarantee of results

Trading foreign exchange, indices, futures, CFDs, cryptocurrencies and other leveraged products carries a high level of risk and is not suitable for everyone. You can lose some or all of your capital and, with leverage, potentially more than your initial deposit. Only trade with money you can afford to lose.

We make no promise, guarantee or representation that you will make money or achieve any particular result. Any examples, past trades, charts or performance discussed are for illustration only. Past performance, whether actual or hypothetical, does not indicate future results. Your results depend on many factors outside our control, including your own skill, discipline, capital and market conditions.

6. Subscriptions, billing and renewals

Memberships are recurring subscriptions. Checkout and membership management are provided by LaunchPass, and payments are processed by Stripe. By subscribing, you authorise us, through LaunchPass and Stripe, to charge your payment method:

• the price shown at checkout when you subscribe; and
• the same amount again at the start of each new billing period (every month, every three months or every year, depending on your plan) until you cancel.

Your subscription renews automatically unless you cancel before the next renewal date. Prices are shown in US dollars unless stated otherwise. You are responsible for any taxes, currency conversion fees or bank charges that apply to your payment.

We may change membership prices. Any change applies from your next renewal after we have given you notice, and you can cancel before then if you do not want to continue at the new price.

If a payment fails or is reversed, your access may be paused or removed until the outstanding amount is paid.

7. Cancellation

You can cancel your subscription at any time through your LaunchPass account. Cancelling stops future renewals. You keep access until the end of the billing period you have already paid for, after which your access ends.

Cancelling does not entitle you to a refund or credit for any part of the current billing period, including unused time.

8. All sales are final. No refunds

All purchases are final and non-refundable. We do not offer refunds, credits or partial refunds for any reason, including but not limited to:

• change of mind, or deciding the Service is not for you;
• not using, or not fully using, the membership or any part of it;
• unused time remaining in a billing period after you cancel;
• forgetting to cancel before a renewal;
• your trading results;
• suspension or termination of your access for breaching these Terms.

The Service is digital content and is made available to you immediately after payment. By completing your purchase, you expressly request immediate access and acknowledge that, where the law allows, you lose any statutory right to cancel or withdraw from the purchase once access has been provided.

Everything included in the membership is described on this website before you buy. If you are unsure, we encourage you to start with the monthly plan.

9. Chargebacks and payment disputes

If you have a problem with a payment, please contact us first at ipdatrader@gmail.com so we can look into it.

Opening a chargeback or payment dispute for a purchase you authorised, including one made in breach of the no-refund policy above, is a breach of these Terms. If you do this, we may immediately and permanently remove your access to the Service, and we may contest the dispute by providing your payment processor or bank with evidence of your purchase, your agreement to these Terms and your use of the Service.

10. Your account and access

Your membership is personal to you. You may not share, transfer, sell or lend your access, your Discord account access, session links or login details to anyone else, and only one person may use each membership.

To access the community you need a Discord account, and to join live sessions you may need Zoom. You are responsible for your own devices, internet connection and third-party accounts, and for keeping them secure.

11. Intellectual property

All content provided through the Service, including videos, lessons, strategies, documents, recordings, outlooks, charts, text, graphics and the IPDATrader name and branding, is owned by or licensed to IPDATrader and is protected by copyright and other intellectual property laws.

While your membership is active, we give you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the content for your own private education. You may not, without our prior written permission:

• copy, download, record, screenshot for distribution, or capture any content, including live sessions;
• share, publish, redistribute, resell, sublicense or make any content available to anyone else;
• use any content to create, teach, sell or promote a competing course, community, signal service or similar product;
• use any content to train or develop artificial intelligence or machine learning models.

Breaching this section may result in immediate termination of your access without a refund, and we may take legal action to protect our rights.

12. Community rules

The community only works if it is respectful and useful for everyone. When using the Discord, live sessions or any other part of the Service, you agree not to:

• harass, abuse, threaten, discriminate against or impersonate anyone;
• post spam, advertising, referral or affiliate links, or promote other paid groups, signal services or products;
• solicit members, or offer trade signals, account management or financial services to them;
• share anything illegal, misleading, or anything that infringes someone else's rights;
• share other members' personal information or private messages without their consent;
• disrupt sessions, or attempt to interfere with the Service or other members' use of it.

We may remove content, mute or remove members, and decide what is acceptable at our sole discretion.

13. Suspension and termination

We may suspend or terminate your access to all or part of the Service, immediately and without notice or refund, if we reasonably believe you have breached these Terms, behaved in a way that harms the community or IPDATrader, or used the Service unlawfully. We may also cancel your subscription and stop future charges.

We may discontinue the Service as a whole. If we do, we will stop charging you and will not renew your subscription.

Sections 4, 5, 8, 9, 11 and 14 to 19 continue to apply after your membership ends.

14. Third-party services

The Service relies on third-party services, including LaunchPass, Stripe, Discord, Zoom and YouTube. Your use of them is subject to their own terms and privacy policies. We are not responsible for their availability, performance, outages, changes or actions, or for any loss caused by them.

15. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness or uninterrupted availability. We do not warrant that the content is free of errors, or that the Service will meet your expectations or produce any particular result.

16. Limitation of liability

To the fullest extent permitted by law, IPDATrader and its owners, team members and partners will not be liable for:

• any trading or investment losses, or any loss of profit, income, capital or opportunity;
• any indirect, incidental, special, consequential or punitive damages;
• any loss arising from your reliance on any content, opinion or information provided through the Service;
• any loss caused by third-party services, technical problems or events outside our reasonable control,

even if we have been told such loss is possible.

To the fullest extent permitted by law, our total liability to you for any claim relating to the Service or these Terms is limited to the total amount you paid us for the membership in the three (3) months before the event giving rise to the claim.

17. Indemnity

You agree to indemnify and hold harmless IPDATrader and its owners and team members from any claims, losses, liabilities, damages and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service or content, your trading decisions, or your violation of any law or the rights of anyone else.

18. Your statutory rights

Some jurisdictions do not allow certain exclusions or limitations, so some parts of these Terms may not apply to you. Nothing in these Terms excludes or limits any right or liability that cannot be excluded or limited under the law that applies to you.

19. Disputes

Before starting any formal claim, you agree to contact us at ipdatrader@gmail.com and give us 30 days to try to resolve the issue informally.

20. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes apply from the date they are posted, and to existing subscriptions from your next renewal. If you continue to use the Service after that, you accept the updated Terms. If you do not agree, you can cancel your subscription.

21. General

If any part of these Terms is found to be invalid or unenforceable, the rest remains in full effect. If we do not enforce a right, that does not mean we have given it up. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale or reorganisation of the business. These Terms, together with our Privacy Policy and the risk disclosure on this website, are the entire agreement between you and us about the Service.
